Daily Fantasy Sports (DFS) giants like FanDuel and DraftKings offer their games in approximately 40 U.S. states. About half of those states passed legislation making DFS explicitly legal.

New Jersey is one of the states with an official pro-DFS stance. Former Gov. Chris Christie signed bill N.J. A 3532 into law in August 2017.

Christie’s signature on the bill didn’t really change anything about the actual operations of DFS sites in the state. FanDuel and DraftKings were already available to New Jersey players at the time. The first state-regulated DFS site, FastPick, by way of Resorts Atlantic City was also available.

Online Gambling In New Jersey: A Brief History

Online gambling became legal in New Jersey in February 2013, when former Gov. Chris Christie signed an online gaming bill into law. New Jersey was the first state to begin offering legalized online gambling, after a few major shifts in federal law paved the way.

The Wire Act

The most significant of these shifts came with the 2011 U.S. Department of Justice (DOJ) opinion on the 1961 Wire Act. Under the original language of the Wire Act, any gambling-related transaction using a “wire communication” was illegal.

With this language in place, online casino gambling was explicitly illegal on a federal level. In 2011, the DOJ issued an opinion that the Wire Act only applied to sports betting transactions that crossed state lines.

The new DOJ opinion opened the possibility for individual states to legalize online gambling, within state borders, if they chose to do so.

New Jersey’s Live Casino Industry
